THIS PRIVACY POLICY APPLIES TO THE WEBSITES AND APPS WHERE IT APPEARS.
This Policy (together with our Terms and Conditions of Use and our Tracking Tools Policy) describes how we treat information we collect from or about you on the websites and apps where it is located, and offline where this Policy is referenced. By accessing or using our websites and apps or interacting with us, you acknowledge these practices.
For the purpose of European data protection laws, D'Addario & Company, Inc., 595 Smith Street, Farmingdale, New York, 11735, United States, acts as a controller in connection with certain personal data described in this Policy.
If you are a California resident, see Section 6 for additional information provided pursuant to the California Consumer Privacy Act, including information on submitting requests that we not sell or share your personal information by clicking Do Not Sell or Share My Personal Information.
1. We collect and use information from and about you.
D'Addario (and the vendors we hire to perform business functions on our behalf) collect, receive, hold and develop several categories of personal information about you depending on the nature of your interactions with us:
We collect contact information. For example, we collect your name, email address, account username and password, social media handles, phone number and mailing address.
We collect demographic information. We collect information like your gender and age.
We collect payment information. We collect your credit, debit, or other payment card details if you make a purchase.
We collect information you submit or post. For example, we collect product reviews and comments that you post on our site and your responses to surveys you complete. We collect information when you contact us.
We collect transaction and preference data. We collect information about your purchase history and transactions and your preferences when using our products and services.
We may collect information about what instruments you play.
We collect Internet and network activity information and device information. If you use our website, we may collect information about the browser you're using or your IP address. We might also collect device identifiers, including the hardware models, operating systems and versions, software, preferred languages, unique device identifiers, advertising identifiers, serial numbers, device information, and mobile network information. We might look at what site you came from, or what site you visit when you leave us. We may collect page interaction information (such as what areas of the websites you visit and for how long, what search terms you enter, and what products or content you view and click on), and methods used to browse away from the page. If you use our mobile apps, we may also look at how often you use the app and where you downloaded it. We may engage or allow other parties to collect information on our websites and apps in these ways. We collect this information using the tracking tools described below. We collect location information. We may passively collect your location when you access our sites. We also collect information about your location using your ZIP code or postcode and IP address.
We collect employment-related information. When you apply for a job, we collect information you submit as part of your application and resume. This might include your work experience and previous employment, your education, the URL to your personal or professional websites, your workplace skill sets and certifications, whether you need a visa to work in the United States, and/or salary expectations. If you apply for a job, you can choose to also voluntarily provide any of the following information: ethnicity, gender, disability status, and/or veteran status.
We collect and develop inferences. Using the other pieces of personal information collected about you, we draw inferences about you, reflecting what we believe to be your preferences, characteristics, predispositions, and attitudes.
2. We collect, hold, use, and disclose information for the purposes described and disclosed here
We use information to provide our services, fulfill your orders and respond to your requests or questions. For example, we collect your information to provide you instructions, contact you about your loyalty account, or to obtain feedback. We use your information to fulfill your purchases. We also use your information to create and administer your account.
We use information to improve our products and services. We use your information to make our website, services, and products better. We use your information to customize your experience with us.
We use information to administer our site and services and for internal operations. This might include troubleshooting, data analysis or testing. We also use information for research, statistical and survey purposes.
We use information for security purposes. We use information to protect our company or others, including customers or business partners. We also use information to protect, our websites or our services, as well as to detect and investigate activities that may be illegal or prohibited.
We use information for marketing purposes. For example, we might provide you with information about special promotions, contests, sweepstakes, or offers or send push notifications on our apps. We might also use your information to serve you ads about our products and offers and tell you about new features or services. These might be our own offers or products, or third-party offers or products we think you might find interesting. We may also use your data in order to build profiles and infer what advertising may be of interest to you. If you register with us, you may opt-in to receive our email newsletter. We use information to conduct research and analysis. We use information for research, statistical, and survey purposes.
We use information to communicate with you about your account or our relationship. For example, we might send you emails about your loyalty account or feedback. We might also contact you about our policies or our website terms. We may also use push notifications on our apps (subject to your preference selections and depending on the operating system and device you use).
We use information for hiring purposes. We use information to review your job applications and contact you about employment opportunities.
We use information to verify requests made pursuant to this Policy. We will use certain pieces of personal information to verify your identity if you make requests pursuant to this Policy. The verification steps and the pieces of personal information that we request may vary depending on the sensitivity and nature of your request. For more information regarding verification of requests, please see Section 6 below.
We use information as otherwise disclosed or permitted by law, or as we may notify you from time to time.
3. We collect information in different ways.
We collect information directly from you. For example, we collect information if you sign up for an account or sign up for our emails. We also collect information if you make a purchase or contact us. We also collect information if you post a comment, make a request, complete a survey, or apply for a job.
We collect information from your devices. We use tracking tools like browser cookies and web beacons to automatically collect information from and about you. We collect information when you interact with our websites and apps, our ads, and our emails that we or our vendors send to you. We collect information about users over time and across devices when you use this website. We may have other parties collect personal information this way. We get information about you from vendors we hire to work on our behalf and from other sources. Other parties may give us information about you. These other parties might include business and marketing partners and social media platforms that give us information they have collected either directly or indirectly from you. Vendors that host or maintain our websites and send promotional emails for us may also give us information. Our employment and recruiting vendors, marketing agencies, advertising technology vendors, and analytics providers may also provide us with information.
We combine information. For example, we may combine information that we have collected offline with information we collect online. Or we may combine information we get from another party with information we already have. We may also aggregate your information with other consumers' information to understand preferences and trends over time.
4. We share your information with others.
We will share information within the D’Addario family of companies. This includes our subsidiaries and affiliates. This also includes our brands, such as D'Addario Accessories, Evans Drumheads, Promark Drumsticks, D'Addario Woodwinds, and PureSound Percussion. We may share your information with our affiliates in order for them to communicate product offers, listings and events that we believe you might be interested in.
We will share your information with vendors and service providers who perform services on our behalf. For example, we share information with vendors who send emails for us. We also share information with companies that help us manage and operate our websites and apps or fulfill purchases. We also share information with other parties like advertisers and advertising networks, social media companies, and ad tech companies that assist us in marketing and advertising our products or services. We may also share information with analytics and search engine providers, and with vendors that track advertising impressions, investigate and prevent data incidents, audit our business and financial statements, vet job applicants, provide legal advice, and place our advertisements on other platforms.
We may share your information with our business partners including for marketing purposes. For example, we might share information with other parties who co-sponsor a promotion. We might also share information with our distributors and dealers. Some of these partners may send you information about products or services by mail or email. They may share your information with others.
We will share your information if we think we have to in order to comply with the law or to protect ourselves, our customers and others. For example, we may share information to respond to a court order or subpoena. We may also share information if a government agency or investigatory body requests it. This includes sharing your information with the US government.
We might also share your information in order to enforce our agreements, and to protect the rights of others. We might also share information when we are investigating potential fraud. This might include fraud we think has happened during a promotion. If you are the winner of a sweepstakes or contest, we may also share your information with anyone who requests a winner’s list.
We may share your information with a successor to all or part of our business. For example, if part of our business is sold, we may include user information as part of that transaction. We may also share your information if there is a similar change to our corporate structure. We may also share your information with others as they conduct diligence of our corporate changes.
We may share information for other reasons we may describe to you from time to time as permitted by law.
5. You have certain choices about how we use your information.
You can opt out of receiving our marketing emails. To stop receiving our promotional emails, you can change your account settings on the site, follow the instructions in any promotional message you get from us, or email us at privacypolicy@daddario.com. Even if you opt out of getting marketing messages, we will still send you transactional messages. These include responses to your questions or updates on your purchases.
You can control whether we share information with other parties for their marketing purposes. To opt out of having us share your information with other parties for their promotional purposes, please send an email to privacypolicy@daddario.com.
You can control certain cookies and tracking tools. We collect information about users over time and across different websites and devices. To do this, we and our vendors use several common tracking tools, such as browser cookies, web beacons, and similar technologies. Nevada Privacy Rights. If you are a Nevada resident, you can request that we not “sell” your “covered information” (as defined in applicable Nevada law). To make such a request, email us at privacypolicy@daddario.com. Please use “Nevada Do Not Sell” in the subject line.
6. Your California Privacy Rights.
If you reside in California, you have the right to ask us one time each year if we have shared personal information with third parties for their direct marketing purposes. To make a request, please send us an email to privacypolicy@daddario.com, or write to us at the address listed below. Indicate in your letter that you are a California resident making a “Shine the Light” inquiry.
If you are a California resident, you can also make the following requests regarding your "Personal Information" (as defined in the California Consumer Privacy Act):
- Access – You can request that we disclose to you the categories of Personal Information we collected about you, the categories of sources from which we collected the Personal Information, the categories of Personal Information we sold or disclosed, our business or commercial purpose for collecting and selling your Personal Information, the categories of third parties with whom we shared your Personal Information, and the specific pieces of Personal Information we collected about you over the past 12 months.
- Correction - You can request that we correct inaccurate personal information that we maintain about you.
- Deletion – You can request that we delete your Personal Information that we maintain about you, subject to certain exceptions.
- Do Not Sell or Share My Personal Information – You can request that we not sell your Personal Information by clicking Do Not Sell or Share My Personal Information. For purposes of this Section, "sell" means the sale of your personal information to a third party for monetary or other valuable consideration, and “share” means the disclosure of your personal information for cross-context behavioral advertising purposes, subject to certain exceptions in the California Consumer Privacy Act. As described above, cookies and other technologies may be used on our sites to recognize you and receive information about your activity on our websites. This helps customize content and show you more relevant ads on our sites and others. If you make a request to opt-out of sale or sharing and you would like to opt-out of such tracking for behavioral advertising purposes, separately update your cookie preferences in the Cookie Center (see link at the top of this Privacy Policy) or broadcast the Global Privacy Control opt-out preference signal (on the browsers or browser extensions that support such a signal). Additionally, you can opt-out of certain uses of cookies for advertising purposes by visiting www.aboutads.info/choices and https://optout.privacyrights.info/. Your selections are specific to the device, website and browser you are using. Your selections are deleted whenever you clear your cookies or browser’s cache. We do not knowingly sell or share the personal information of minors under 16 years of age.
We will not discriminate against you because you made any of these requests.

We will take reasonable steps to verify your identity prior to responding to your requests. The verification steps may vary depending on the sensitivity of the personal information and whether you have an account with us. California residents may designate an authorized agent to make a request on their behalf. When submitting the request, please ensure the authorized agent is identified as an authorized agent.
We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. For example, we may retain personal information as permitted or required by law, such as for tax or other record keeping purposes, to maintain an active account, and to process transactions and facilitate customer requests.
For purposes of these requests, please note the following regarding how we collect and use your personal information as described in this Policy, including in the previous 12 months:
- We collect and use categories of Personal Information for the business and commercial purposes described in this Policy, including: Identifiers; payment and customer records information; characteristics of protected classifications under California or federal law (such as demographic information like age and gender); commercial information; professional or employment information; education information; Internet or other electronic network activity information; geolocation data; audio, electronic or visual information; and inferences. See Section 1 above for additional detail.
- We collect and use these categories of Personal Information for the business and commercial purposes described in Section 2 of this Policy.
- We collect these categories of Personal Information from the sources described in Section 3 above.
- We disclose each of these categories of Personal Information for our business and commercial purposes to the extent permitted by applicable law as described in Section 4 of this Policy.
- We may "sell" or “share” the following categories of Personal Information: Identifiers; payment and customer records information; characteristics of protected classifications under California or federal law; commercial information; Internet or other electronic network activity; geolocation data; and inferences. We may "sell" or “share” these categories of Personal Information to the categories of third parties described in Section 4 of this Policy for the commercial or business purposes described in Section 2 of this Policy.
From time to time, we may collect personal information in connection with a promotion, offer, program, or discount or other financial incentive. The material terms of the financial incentive will generally be presented to you at the time you sign up. The incentives made available through them are generally related to the value of the relationships that we have with the individuals who participate. Participation is voluntary and you may withdraw at any time by emailing us at privacypolicy@daddario.com.
We keep personal information as long as it is relevant or necessary for the practices described in this Privacy Policy, including, for example, for compliance, dispute resolution, contract enforcement, backup, archival, advertising, and other business and internal operations purposes. We also keep information as otherwise required or permitted by law.
7. These sites are not intended for children.
Our websites and apps where this Policy is found are meant for adults. We do not knowingly collect personally identifiable information from children under 18 without permission from a parent or guardian. If you are a parent or legal guardian and think your child under 18 has given us information, you can contact us at privacypolicy@daddario.com. You can also write to us at the address listed at the end of this Policy. Please mark your inquiries "Children's Information Request." 8. We use security measures.
The Internet is not 100% secure. We cannot promise that your use of our sites or services will be completely safe. Any transmission of your data to our site is at your own risk. We encourage you to use caution when using the Internet. This includes not sharing your passwords. We keep personal information as long as it is necessary or relevant for the practices described in this Policy. We also keep information as otherwise required by law.
9. We may process and store information in the United States.
Information we collect from you may be transferred to, processed in, or stored in the United States or another destination outside of the European Economic Area (“EEA”). Information may be processed by personnel operating in these locations who work for us or one of our business partners. The standard of data protection in the United States and in certain other countries where we may process your information is considered by the European Commission to be not adequate when compared to the data protection standards of the UK, EU and EEA. By using our websites or submitting your personal data, you consent to such transfer, storing and processing.
10. Your UK, EU and Other Privacy Rights.
As detailed below, where provided under applicable law, you may request information about the personal information about you that we hold, and you may ask about all recipients of the information, the purpose of the processing, request the correction of incorrect information, and request the blocking, deletion and portability of such information by contacting us at privacypolicy@daddario.com. We may require you to prove your identity with approved identification if you request this information.
Lawful basis for processing your personal data.
We process on the following legal bases:
1. Contract: It is necessary for our performance of the contract you have agreed to enter with us. If you do not provide your personal data to us, we will not be able to carry out our obligations under the terms of the contract.
2. Legitimate Interests: We are permitted to process your personal data if it is based on our legitimate interests. In relation to general inquiry and complaints you send us, our legitimate interest is to provide you with information you have requested and to provide customer support. You can object to the processing that we carry out on the grounds of legitimate interests. See the section "Rights of data subjects" below to find out how.
3. Consent: Where you have given us consent to do so, we provide you, or permit third parties to provide you, with information about goods or services which we feel may interest you. You have the right to withdraw your consent. Please see the section "Rights of data subjects" below to find out how.
4. Legal Claims: We need to process your personal data to defend or establish a legal claim (for example, claims relating to the sale of our goods and services under contract law).
Rights of data subjects
You have the following rights, where provided under applicable European data protection law, regarding your information (each of which are subject to various exceptions and limitations):
1. The right to be informed: You have the right to be provided with clear, transparent and easily understandable information about how we use your information and your rights. This is why we are providing you with the information in this Policy.
2. The right of access: You have the right to obtain access to your information (if we are processing it), and other certain other information (similar to that provided in this Policy). This is so you are aware and can check that we are using your information in accordance with data protection law.
3. The right to rectification: You are entitled to have your information corrected if it is inaccurate or incomplete.
4. The right to erasure: This is also known as ‘the right to be forgotten’ and, in simple terms, enables you to request the deletion or removal of your information where there’s no compelling reason for us to keep using it. This is not a general right to erasure; there are exceptions.
5. The right to restrict processing: You have rights to ‘block’ or suppress further use of your information. When processing is restricted, we can still store your information. We keep lists of people who have asked for further use of their information to be ‘blocked’ to make sure the restriction is respected in future.
6. The right to data portability: You have rights to obtain and reuse your personal data for your own purposes across different services and platforms.
7. The right to object: You have the right to object to certain types of processing, in particular processing based on our legitimate interests. You also can object at any time to your information being used for direct marketing purposes (including profiling related to such direct marketing). Where you object to processing for direct marketing purposes, the personal data shall no longer be processed for such purposes.
8. The right to refuse or withdraw consent: You have the right to refuse to provide and withdraw your consent to processing of your personal information at any time with effect for future processing.
If you are not satisfied with our response to your complaint or believe our processing of your information does not comply with data protection law, you can make a complaint to the UK Information Commissioner's Office (ICO): https://ico.org.uk/concerns/.
Please note your rights in relation to your personal data are not absolute. We may, for example, deny you access to your personal data when required or authorized by law, or if granting access would have an unreasonable impact on another individual’s privacy.
We will retain and use your personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
11. Your Australia Privacy Rights
We may store your personal information in physical and electronic formats and may outsource our electronic storage to a third party to store information on our behalf. We utilise a mix of security measures in connection with the information we hold including certain technological measures.
We may disclose your information to overseas recipients for the purposes set out in this Privacy Policy, including to any of the entities mentioned in Section 4 above (who may be located in the United States, the United Kingdom, and Europe). Where we disclose your information to recipients outside of Australia, we will take reasonable steps to protect your information. However, where you agree to our disclosure of your information to any overseas recipient, you agree that we will not be required to ensure the overseas recipient complies with Australian privacy law.
If some or all of the types of personal information referenced in this Privacy Policy are not collected, you may not be able to access our products and services, and we may not be able to fulfill your transactions or carry out the uses outlined in this Privacy Policy.
You may seek access or request correction of your information by contacting us using the information provided in Section 13 below.
You can also make a complaint about our breach of an Australian Privacy Principle under Australian privacy laws by contacting our Privacy Officer through the information provided in Section 13 below. Once we receive your complaint, we will investigate and attempt to resolve all requests and complaints in a timely manner. If you are not satisfied with our handling of your request or complaint, you may be entitled to make a complaint to the Office of the Australian Information Commissioner.
12. We may link to third party sites or services we don’t control.
If you click on a link to a third party site, you will be taken to a website we do not control. This Policy does not apply to the privacy practices of that website, which may collect information from or about you. Read the privacy policy of other websites carefully. We are not responsible for these third party websites or their policies.
Our site may also serve third party ads or content that contains third party cookies or tracking technologies. We do not control the use of those technologies.

From time to time we may change our privacy policies. We will notify you of any material changes to our Policy as required by law. We will also post an updated copy on our site. Please check our site periodically for updates. Your continued use of our website and apps means that you consent to the collection, use and disclosure of your personal information as set out in the updated Policy.
